Taraba poll: Gov Ishaku wins at Supreme Court.

The Supreme Court has upheld the election of Darius Ishaku of the Peoples Democratic Party, PDP as the governor of Taraba State.

In a unanimous decision on Thursday, the seven-man panel of judges of the Supreme Court dismissed the appeal filed by Senator Aisha Jumai Alhassan of the All Progressives Congress, APC.

In the lead judgment read by Justice Bode Rhodes-Vivour, the Supreme Court affirmed the earlier judgment of the Court of Appeal in Abuja ‎which declared Gov Ishaku the winner of the 2015 gubernatorial contest.

“I am of the firm view that there is no merit in this appeal and it is hereby dismissed. The judgment of the ‎Court of Appeal is affirmed and the election of governor Darius Ishaku is hereby upheld”, Justice Rhodes-Vivour declared.

The judges however deferred the reasons for the judgement till February 22.

Senator Alhassan a serving Minister of Women affairs, had gone to the Supreme Court seeking to upturn the verdict of the Abuja Division of the Court of Appeal which had earlier upheld Ishaku’s election as the governor of Taraba State.

The Court of Appeal had on December 31, 2015, upturned the judgment of the Taraba State Governorship Election Petition Tribunal which declared Alhassan the winner of the election.

How ex-Minister allocated lands to Jonathan, others in violation of Abuja masterplan

Former Minister of the Federal Capital Territory, Bala Mohammed has been indicted by the Senate Committee on FCT for appropriating reserved plots of land in Abuja to ex-President Goodluck Jonathan and some of the ministers in his cabinet.

The committee said that the  plots acquired by Jonathan and his ministers were designated as green areas, flood drains, city buffers, recreation centres, sewage lines, urban farming and city monuments.

The Chairman of the committee , Senator Dino Melaye told journalists on Wednesday that the illegally acquired lands are within the highbrow Maitama District.

He blamed what he described as the "satanic" action of the former president and his ministers on Bala Mohammed's indiscretion.

The committee listed beneficiaries of the “land grab” to include former President Goodluck Jonathan, former Petroleum Minister Mrs. Diezani Alison-Madueke, former Justice Minister Mohammed Adoke, former Trade and Investment Minister Olusegun Aganga, Acting National Chairman of the Peoples Democratic Party (PDP), Uche Secondus and FCT Executive Director Ismaila Adamu.

Melaye said that some of the beneficiaries have started erecting structures on the plots, that were “hurriedly allocated” in the last days of the Jonathan administration with Certificates of Occupancy hurriedly issued.

According to Melaye, “Senator Bala Mohammed, in his bid to satisfy some powerful Nigerians before the end of his tenure, disregarded the wisdom of his predecessors and the vision of the founding fathers of Abuja.

“He went ahead to implement Messrs Fola Consult Limited’s recommendation by allocating these important features/endowments, including the Maitama Hills, to these powerful Nigerians.

“It is pathetic to state that one of the allottees has erroneously burst a sewage conduit pipe and the entire area messed up with offensive odour which could trigger off serious epidemic within that location.”

Abujacitynews was reliably informed that the committee plans to place a Stop Work Order on the projects going on at the illegally acquired plots of land.

It was also gathered that the illegal allottees would be required to replace the trees felled in the course of construction in the area.

Ultimate Wonder Promo: CPC orders MTN to pay winner N1.85m

The Consumer Protection Council, CPC has given MTN Nigeria 14 days within which to pay N1.85m to a winner of its Ultimate Wonder Promo, Mr Omeje Fidelis for lack of due diligence.

The order was sequel to a complaint of underpayment lodged by Omeje Fidelis who was declared winner of MTN Ultimate Wonder Promo in 2012.

Omeje said that he participated in the promo and was called through MTN customer service line 180 on October 10, 2012 that he had won N2m in the Ultimate Wonder Promo and that on October 12 of the same year he got a text message informing him of the presentation ceremony scheduled for October 19 at the Nicon Luxury Hotel, Abuja.

Omeje  said that during the  ceremony, he was presented with a dummy cheque of N2m with his name on it, interviewed and paraded before the media and the world as a winner of the said amount.

He  added that he was shocked to receive another call from MTN customer service line 180 on November 2, 2012 that his winning was N150,000 and was subsequently given a Verve ATM card for that amount.

MTN however denied the complainant's claim saying that he was from the on-set informed that his winning was N150,000 but he deceitfully presented himself when winners in the N2m category were called forward on the day of the prize presentation.

MTN also said that Omeje’s antics were discovered at the verification of winners, which was done after the ceremony and he was thereafter contacted through its 180 customer service line on his misrepresentation following which he apologised.

However, the CPC said that MTN refused to provide the call data of the communications of the 10th of October 2012 when Omeje was informed of his winning of N150,000.

In a statement signed by the CPC Spokesman, Mr. Abiodun Obimuyiwa, the Council said that MTN refused and neglected to comply with the request made both in 2012 and 2016.

“The CPC, in its Orders, frowned at the consistent refusal of MTN to provide the call data records evidencing details of communication with the complainant, declaring that in the absence of this material evidence which is solely in the possession of the respondent the CPC must resolve the issue in favour of the complainant.

“The process of the MTN Ultimate Wonder Promotion whereby the verification exercise was conducted after winners were identified, declared and winnings presented publicly is grossly flawed, lacking in transparency, inequitable and apparently calculated to deceive consumers.

”The CPC, on the strength of these observations, therefore directed MTN to pay within 14 days of receipt of Order, the sum of N1,850,000 being the unpaid part of the N2m prize won by the complainant in the 2012 MTN Ultimate Wonder Promotion."

The Director General of the Consumer Protection Council,
Mrs. Dupe Atoki, reaffirmed that businesses have an obligation to desist from promos that are not honest, transparent, equitable and faithful or designed to deceive consumers.
